User Agreement (Offer Agreement) of Almaty Museum of Arts
This document – the "User Agreement" – is a public offer within the meaning of the Civil Code of the Republic of Kazakhstan. Payment for the Museum's services or goods and/or completion of the order on the www.almaty.art website is an unconditional acceptance of the terms and conditions of this Agreement. The agreement applies to the purchase of services at the ticket offices and on the official website of the Museum.
1. Terms and Definitions
1.1. Museum – Corporate Foundation "Almaty Museum of Arts".
1.2. Visitor means an individual (or an authorized representative of a legal entity) who purchases the Museum's services/goods.
1.3. Parties – the Museum and the Visitor.
1.4. Website – the official website of the www.almaty.art Museum.
1.5. Event – an exhibition, a visit to a permanent exhibition, a lecture, a concert, an excursion or any other event that can be attended with a Ticket.
1.6. Ticket – a document on paper or in electronic form (QR code) certifying the Visitor's right to attend the Event; can be nominal.
1.7. Electronic Order – one or more Tickets for one Event, united by a single order number.
1.8. Booking – short-term reservation of Tickets until the moment of payment; The booking period is indicated at the payment stage.
1.9. Payment (Payment) – transfer of funds for services/goods (cash, bank cards, electronic payments, QR).
1.10. Cash (fiscal) check is a document generated by cash registers in accordance with the legislation of the Republic of Kazakhstan and confirming payment.
1.11. Refund – a refund for unused Tickets in the manner and within the time limits established by this Agreement.
1.12. Membership (Subscription) is a loyalty program card of the Museum (including in electronic form) that grants the Visitor the right to multiple visits to the Museum and/or participation in Museum events, as well as the receipt of other privileges within the framework of the relevant Museum program for a specified period of validity, in accordance with this User Agreement and the description of the specific membership pass on the Website.
2. Subject of the Agreement
2.1. The Agreement regulates the relationship between the Visitor and the Museum when purchasing the Museum's services and goods on the Website and at the ticket office, is a public contract of adhesion and is governed by the laws of the Republic of Kazakhstan (including the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Protection of Consumer Rights", the Law of the Republic of Kazakhstan "On Culture", the Law of the Republic of Kazakhstan "On Personal Data and Their Protection", the Law of the Republic of Kazakhstan "On Payments and Payment Systems").
2.2. An electronic ticket is legally equivalent to a paper ticket if there is a fiscal receipt.
3. Procedure for the entry into force of the Agreement
3.1. When purchasing on the Website, the Agreement comes into force from the moment you click the button to confirm your agreement with the terms of the Agreement and the Rules of Visiting.
3.2. In case of purchase at the cash desks – from the moment the cashier starts making the purchase at the request of the Visitor.
3.3. The Museum has the right to change the Agreement by publishing the current version on www.almaty.art. For each new order, the version in force at the time of registration is applied.
4. Rights and obligations of the Parties
4.1. Rights of the Visitor:
4.1.1. Receive information from the Museum's official sources about events, prices, ticket types, and rules for their sale and refund.
4.1.2. Purchase Tickets on the Website and at the box office; to make a Refund in the manner and within the time limits established by the Agreement.
4.1.3. Attend the Museum's Events on the basis of a valid Ticket and a fiscal receipt.
4.2. Obligations of the Visitor:
4.2.1. Comply with the terms of the Agreement and the Rules for Visiting the Museum.
4.2.2. Check the correctness of personal data and order parameters when making an online purchase.
4.2.3. Upon request, present an identity document, as well as a document confirming the benefit (for discounted/personalized tickets).
4.2.4. Provide a readable Ticket (paper or electronic) for control.
4.3. The Museum's rights:
4.3.1. Change prices and establish special terms of sale for individual Events.
4.3.2. Limit the number of Tickets in one order and the number of orders created at the same time.
4.3.3. Refuse entry in case of violation of the Rules of Visitation, presentation of fake or damaged tickets, as well as in the absence of documents confirming the privilege or identity for a personalized ticket. In these cases, the cost of the ticket is non-refundable.
4.3.4. Sell Tickets with special refund conditions (including non-refundable) within the framework of special programs, informing about it before purchase.
4.4. Responsibilities of the Museum:
4.4.1. Provide reliable and sufficient information about events, prices, types of Tickets, rules for sale and refund.
4.4.2. Provide the opportunity to purchase Tickets at the ticket offices and/or on the Website and make a Refund in accordance with the rules of this Agreement.
4.4.3. Ensure the processing of personal data in accordance with the legislation of the Republic of Kazakhstan.
5. Rules for the purchase and return of tickets on the Website
5.1. The currency of payment and refund is the tenge of the Republic of Kazakhstan (KZT). Payment is possible by bank cards, electronic payments and QR.
5.2. After selecting the Tickets, the Visitor fills out an electronic form, confirms his agreement with the Agreement and the Rules, and completes the payment on the side of the acquiring bank/payment service.
5.3. In case of successful payment, the Electronic Ticket is sent to the Visitor's e-mail and/or becomes available in the personal account. The absence of a letter for reasons beyond the control of the Museum (mail filters, address errors) is not a confirmation of non-completion of the order.
5.4. Payment security is ensured by the acquiring bank/payment service in accordance with applicable security standards.
5.5. The Museum has the right to cancel an order in the event of the expiration of the booking period without payment, a technical failure or the cancellation/replacement of the Event; In the latter case, 100% of the order value is refunded.
6. Rules for purchasing and returning tickets at the box office
6.1. Payment at the cash desks is possible in cash, by bank cards and other available methods. Discounted tickets are sold upon presentation of supporting documents.
6.2. Unused Tickets purchased at the Museum's ticket offices shall be refunded at the Museum's ticket offices within the time limits set forth in Section 7.
7. Terms of ticket refund and the amount to be refunded
7.1. The refund period and the amount of the amount depend on the type of Ticket. The time of receipt of the application is the moment of receipt of the application at the address of the billing@almaty.art or the transfer of the paper application to the cash desk. The deadline for return is until 23:59 of the day preceding the date of the visit
7.2. Partial refund of the cost of a combined ticket or season ticket after the first event is not made for it.The inability of the Visitor to take part in one or more events included in the season ticket or a package ticket is not a basis for a refund.
7.3. The Exchange of the Ticket for another date/session/event is not carried out, unless otherwise expressly indicated during the sale.
7.4. Late return for documented reasons (illness of the Visitor/close family member, death of a close relative) is possible with a 100% refund upon submission of the application no later than the date of the visit and submission of supporting documents within 14 days.
8. Memberships and Loyalty Programs
8.1. The Museum has the right to offer Memberships, membership cards, and other loyalty programs (including the “Dostar” program) under the terms of this User Agreement (Public offer), as well as the terms specified on the Website in the relevant section.
8.2. The purchase of memberships is carried out:
8.2.1. on the official Website of the Museum;
8.2.2. at the Museum ticket offices;
8.2.3. in the form of gift membership cards;
8.2.4. at the Museum ticket offices with subsequent activation by the recipient.
8.3. A membership card is valid for 12 (twelve) months from the date of activation, unless otherwise specified at the time of sale or in the description of the specific membership card.
8.4. A membership card is subject to mandatory activation at the Museum ticket office and is considered activated after all of the following actions are completed:
8.4.1. completion of the participant questionnaire;
8.4.2. confirmation of personal data;
8.4.3. personalization and issuance of a named card (where applicable).
8.5. A Membership card may be personalized (registered to a name) and is non-transferable to third parties, except in cases expressly provided for by the terms of a specific Membership level.
8.6. Services under a membership card are deemed properly rendered from the moment the Visitor is granted access to the Museum and/or the ability to use the program privileges, regardless of the actual number of visits.
8.7. Funds paid for a membership card:
8.7.1. are subject to a full refund upon the Visitor's request no later than 10 (ten) calendar days prior to the activation date of the membership card or before the start of its validity period;
8.7.2. are non-refundable after the membership pass has been activated;
8.7.3. are not subject to partial refund in case of full or partial non-use of the membership pass, except as expressly provided by the legislation of the Republic of Kazakhstan.
8.8. In the event of loss, damage, or deterioration of a membership card, the Museum has the right to issue a duplicate card under the conditions established by the Museum, including on a paid basis.
8.9. The Museum is entitled to:
8.9.1. change the composition and content of Membership privileges while maintaining the overall volume of granted rights;
8.9.2. suspend or restrict access under a membership card in case the Visitor violates the Museum Visitation Rules;
8.9.3. refuse service under a membership card if the transfer of the pass to third parties is identified.
8.10. Renewal of a membership is carried out under the terms in effect at the time of renewal. The Museum is entitled to establish special conditions and discounts for the renewal of memberships.
8.11. Free, complimentary, and special membership cards (including volunteer and VIP cards):
8.11.1. have no monetary value;
8.11.2. are not subject to exchange or compensation; they are provided at the discretion of the Museum.
8.12. Payment for a membership card constitutes full and unconditional acceptance of the terms of this Agreement and the terms of the relevant program.
8.13. Other terms for the sale and use of membership cards may be posted on the Website.
9. Personal data
9.1. Processing of personal data is carried out in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection". The Visitor agrees to the processing of personal data for the purposes of fulfilling the Agreement, including the transfer to payment services.
9.2. The Museum takes the necessary measures to protect personal data and does not transfer it to third parties, except as provided for by the legislation of the Republic of Kazakhstan or necessary for the execution of the Agreement.
10. Limitation of Liability
10.1. The Museum is not responsible for the inability to visit for reasons depending on the Visitor, for delays in banks/payment systems, or for the authenticity of tickets purchased from unauthorized persons.
10.2. The Museum's liability is limited to the actual cost of the relevant service/goods, unless otherwise provided by the legislation of the Republic of Kazakhstan.
10.3. Force majeure: The Parties are exempt from liability in the event of force majeure circumstances (emergencies, natural disasters, acts of government agencies, etc.).
11. Final provisions
11.1. To the extent not regulated by this Agreement, the Rules for Visiting the Museum published on the www.almaty.art shall apply.
11.2. The legislation of the Republic of Kazakhstan applies to the relations between the Parties.
Disputes shall be settled through negotiations, and if no agreement is reached, shall be resolved by the courts of the Republic of Kazakhstan at the location of the Museum.
11.3. For corporate clients, other terms of cooperation may be established, which are determined by a separate contract. The draft of the corresponding contract is available on the website www.almaty.art.
